General Conditions of Use and Sales

Article 1: object

These general conditions of use and sale (known as "general conditions") govern navigation on the site: https://www.mfcocoon.com and the provision by M&F COCOON (hereinafter "the Service Provider") of its services to any Internet user or visitor to the site (hereinafter "the User"). The complete identification of the Service Provider is available on the home page of the site.

ARTICLE 2: Access to services

The site allows the User to reserve services with the Service Provider, to make appointments online by the User. The availability of these services is not a firm commitment of the Service Provider, who may at any time restrict their access as well as the scope of the services and functionalities offered, subject to honoring the contracts previously concluded. The site is accessible free of charge anywhere to any User with Internet access. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are his responsibility.

ARTICLE 3: Intellectual Property

The trademarks, logos, signs as well as all the contents of the module (texts, images, threads, etc.) are protected by the Intellectual Property Code and more particularly by copyright. The User must seek the prior authorization of the Service Provider for any reproduction, publication, copy of the various contents. He undertakes to use the contents of the site in a strictly private context, any use for commercial and advertising purposes is strictly prohibited. Any total or partial representation of these elements, by any process whatsoever, without the express authorization of the service provider would constitute an infringement punishable by article L 335-2 and following of the Intellectual Property Code. It is reminded in accordance with article L122-5 of the Intellectual Property Code that the User who reproduces, copies or publishes the protected content must cite the author and his source.

ARTICLE 4: Liability

The User is responsible for the use he makes of the services offered by the Service Provider, in particular for any fraudulent or illicit use of means of payment. The service provider cannot be held responsible for any viruses or malicious programs that could infect the User's computer or any computer equipment, resulting from use, access or download from the site. The User acknowledges and accepts that the Internet network may involve risks related to the lack of protection of certain data against additional diversions and risks of contamination by a malicious program. The Service Provider cannot therefore be held responsible for any loss or alteration of data, any loss of profit, turnover, opportunity, time or any indirect damage, whether said loss or damage is due to negligence, or any other cause. The Service Provider cannot be held liable to the User in the event of unavailability of the functions offered on the site. The liability of the service provider cannot be engaged in the event of force majeure or the unforeseeable and insurmountable act of a third party.

ARTICLE 5: Hypertext links

Hypertext links may be present on the site. The User is informed that by clicking on these links, he will leave the site. The latter has no control over the web pages on these links and cannot, under any circumstances, be responsible for their content.

ARTICLE 6: Online booking and cancellation fees

Online booking allows the User to book a service at a current date and time with the Service Provider from among those offered on the site. The Service Provider undertakes to provide the service reserved by the User.

ARTICLE 7: Withdrawal

In accordance with the provisions of Article L. 211-3 of the Consumer Code, the User who holds a right of withdrawal within the meaning of the Consumer Code has the right to withdraw from his reservation and his orders for products. within fourteen (14) days of the reservation of the services or within fourteen (14) days of the delivery of the products. If the reserved service must be performed within a period of less than this period of fourteen days, the User waives the use of his right of withdrawal. The User is then required to send a registered letter to the postal address or a message via the site's contact form. The User must unequivocally state his desire to withdraw and define the products and services covered by his withdrawal. The User must hand-deliver or return to the referenced service provider the products subject to his withdrawal within fourteen (14) days of exercising the right of withdrawal. He will bear the direct costs of reshipping his order. Products must be returned in their original condition, unopened, undamaged. Products may not be subject to withdrawal when they have been unsealed by the User.

ARTICLE 8: Modification of the present general conditions

The present general conditions can be modified at any time by the service provider and directly applicable when they are put online.

ARTICLE 9: After-sales service - Mediation

The Service Provider can be contacted at any time via the contact form provided for this purpose on the site or at its telephone number provided in its legal notice. The User, when he is a consumer within the meaning of the Consumer Code or the provisions of European law, may, if he wishes, contact any mediator of his choice to resolve any dispute with the Seller.  

ARTICLE 10: Applicable law and competent jurisdiction

French legislation applies to the general conditions, excluding the application of the mandatory laws of the Consumer User's place of residence. The cancellation or invalidation of one of the clauses of these general conditions cannot result in the nullity of the other clauses. In the absence of amicable resolution of a dispute arising between the parties, the French courts will have sole jurisdiction to hear it, excluding the application of the jurisdictional privilege granted to the consumer, in accordance with the provisions of EU Regulation No. 1215/2012 of the European Parliament and of the Council. of December 12, 2012.
